The amended Property Condition Disclosure Act took effect on 20 March 2024 and removed the $500 credit that sellers could give a buyer in place of the disclosure form. That credit had become the default choice because it capped liability. It is gone. All sellers of residential property must now complete and deliver a Property Condition Disclosure Statement to the buyer before the contract of sale is signed. An as is sale does not change that.

The amended form adds seven flood questions

The 2024 amendment added questions about flood risk: whether the property sits in a FEMA 100 year or 500 year floodplain, whether there is a federal requirement to carry flood insurance, whether FEMA assistance was ever received for flood damage, whether flood insurance is in force, whether an elevation certificate exists, and whether a flood claim has been filed. If the house has water history, this is now an explicit written question rather than something a buyer has to think to ask.
