These Terms and Conditions ("Terms") govern your access to and use of the website tryhomewise.com and any related services, content, and communications provided by Homewise Inc. ("Homewise," "we," "us," or "our"). By using the Site or submitting any information, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and the legal owner (or authorized representative of the owner) of any property you submit. By submitting information, you represent that the information is accurate and that you have the authority to share it.

2. No Obligation; Offers Are Non-Binding Until Signed

Submitting your property does not obligate you to sell, and does not obligate Homewise to make an offer. Any cash offer is preliminary and subject to inspection, title review, and a written purchase agreement signed by both parties. Verbal or emailed estimates are not binding contracts.

3. Communications Consent

By submitting your contact information and checking the consent box(es) on our forms, you expressly authorize Homewise and its service providers to contact you at the phone number and email address provided, including by:

  • Live calls, prerecorded messages, and automatic telephone dialing systems;
  • SMS / text messages, including recurring messages related to your property inquiry;
  • Email communications.

Consent is not a condition of purchase or service. You may revoke consent at any time as described below.

4. SMS Terms (A2P 10DLC)

  • Program: Homewise SMS Notifications, transactional and conversational messages related to your property inquiry.
  • Frequency: Recurring, typically 2 to 8 messages per month; frequency varies with inquiry activity.
  • Cost: Message and data rates may apply. Homewise does not charge for messages; your wireless carrier may.
  • Opt-out: Reply STOP to cancel at any time. You will receive a single confirmation that you have been unsubscribed; no further messages will be sent unless you opt back in.
  • Help: Reply HELP for support, or email info@tryhomewise.com.
  • Carriers: Supported on major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
  • Privacy: Mobile information and SMS opt-in data will not be shared with third parties or affiliates for marketing purposes. See our Privacy Policy.

5. Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent information;
  • Submit information about a property you do not own or are not authorized to represent;
  • Use the Site to harass, abuse, or harm another person;
  • Interfere with the Site, attempt to gain unauthorized access, or scrape content without permission.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is owned by Homewise or its licensors and protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Disclaimers

The Site and Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Homewise is not a real estate broker or agent and does not provide legal, tax, or financial advice. Consult licensed professionals before making decisions about your property.

8. Limitation of Liability

To the maximum extent permitted by law, Homewise will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services. Our total aggregate liability for any claim related to these Terms shall not exceed $100.

9. Indemnification

You agree to indemnify and hold Homewise, its officers, employees, and affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.

11. Changes to These Terms

We may update these Terms at any time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
